Big Circle K Giveaway

Official Rules

 

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

 

1. Eligibility        

Big Circle K Giveaway (the “Giveaway”) is open only to legal residents of the 50 United States (and DC) who are at least eighteen (18) years old at the time of entry. Void where prohibited. Proof of residency and age may be required. Employees and directors of Circle K Stores Inc., Sync Marketing LLC and each of their respective parents, subsidiaries, divisions, affiliates, and advertising or promotional agencies or individuals involved with the design, production, execution or distribution of the Giveaway and the immediate family and household members of such individuals, are not eligible to enter or win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, stepsiblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence at least three months a year, whether related or not. In order to enter the Giveaway or receive the prize, you must fully comply with the Official Rules and, by entering, you (and your parent/legal guardian on your behalf if you are under the legal age of majority in your jurisdiction of residence) represent and warrant that you agree to be bound by these Official Rules and the decisions of the Sponsor, whose decisions shall be binding and final in all respects relating to this Giveaway.

3. Timing

The Giveaway begins on March 5, 2025 at 12:01 am Eastern Standard Time (“EST”) and ends on May 6, 2025 at 11:59pm EST (“Giveaway Entry Period”). Sponsor is the official timekeeper for this Giveaway. The Giveaway is governed by these Official Rules and is subject to all applicable federal, state and local laws. 

 

4. How to Enter 

There are multiple ways to enter depending on whether the entrant is or is not at an Inner Circle location. You must opt-in to participate in the Giveaway.

 

Inner Circle Location 

If you visit an Inner Circle Location, you must be an Inner Circle Member and agree to these Giveaway Official Rules to enter. There is no cost associated with becoming an Inner Circle Member. You can become a member at https://www.circlek.com/inner-circle. You can receive entries as follows:

  1. Agree to Giveaway Official Rules: You will automatically receive one (1) entry if you enter your Inner Circle account details and agree to the Giveaway Official Rules. You may only do this once during the Giveaway. 
  2. Purchases at Circle K with Inner Circle Program: After accepting the Giveaway Official Rules and after completing four (4) qualifying transactions at Circle K during the Giveaway Entry Period you will automatically receive ten (10) entries and a reward of your choice. Only purchases made at a participating Inner Circle location, after entering the member ID/phone number linked to the user who accepted the Giveaway Official Rules will count toward rewards progress.
    1. Qualifying purchases include: transactions greater than $0.01 and fuel purchases greater than four (4) gallons per transaction; and one (1) eligible fuel and one (1) eligible in-store merchandise transaction in a thirty (30) minute window will constitute a visit/transaction. Age-restricted items, such as tobacco products, alcohol and lottery, and gift cards, will not count as a transaction/visit unless purchased with other eligible items in a transaction.
    2. A maximum of 10 qualifying visits can be made per day.
  3. Reward choices will be delivered to the customer via transactional email communication within forty-eight (48) hours from completing the fourth qualifying visit. You will have seven (7) days after the email is sent to make your selection. On the eighth (8th) day, if you have not selected your reward, a default reward will be issued to you and placed into your account. Full reward terms can be found at www.circlek.com/inner-circle/terms-and-conditions. Visit-based rewards do not affect your odds of winning prize. Limit of thirteen (13) rewards can earned per entrant during the Giveaway Entry Period.
  4. Purchase Three (3) 20 oz Pepsi Products. After agreeing to the Giveaway Official Rules, you will automatically receive ten (10) entries by purchasing any three (3) 20 oz Pepsi products in the same transaction. You must input your Inner Circle phone number at a participating Inner Circle location. Limit one qualifying group of purchases per day during the Giveaway Entry Period for this method.
  5. Free: Online Entry. You will automatically receive ten (10) entries for completing the online form located at https://app.em.circlek.com/webApp/sweepstakesAMOE a maximum of three (3) times per day during the Giveaway Entry Period for this method.

 

Non-Inner Circle Location

If you visit a non-Inner Circle Location, you will receive entries as follows:

  1. Upload a Circle K Store Receipt. You will automatically receive one (1) entry if you upload a Circle K Store receipt. You will upload the receipt at www.circlek.com. Receipt must be dated within the Giveaway Entry Period. Entrant will have to provide the required information that includes typing in the transaction number from the receipt and the total amount of the receipt. Receipt must not include tobacco, alcohol, gift card or lottery purchase. One receipt upload can only be used one time by one participant. Limit of one entry per person per day during the Giveaway Entry Period for this method.
  2. Enter a Participating Product UPC code. You will automatically receive one (1) entry if you enter a participating product UPC code, or you can enter this UPC code 803331319150. Specific products will be identified as acceptable UPCs to scan for the activity to complete. Limit of one entry per person per day during the Giveaway Entry Period for this method. 
  3. Circle K store Check In. You will automatically receive one entry if you check into a Circle K Store. To complete this activity, location finder must be on for location services to confirm that you are at a Circle K store. Limit of two (2) entries per person per day with 1 hour lapsed between the two store check- ins per day for this method. For the 1st store check-in per day the entrant will get credit for completing the activity, on the 1st of 2 Max check-ins per day, the entrant will also receive 10 bonus entries.
  4. Subscribe to Receive Emails from Circle K. You will automatically receive one (1) entry if you subscribe to marketing or promotional emails from Circle K. Limit of one entry per person during the Giveaway Entry Period for this method.
  5. Visit Circle K on Instagram. You will automatically receive one (1) entry if you visit Circle K on Instagram through the Big Circle K Giveaway website. Limit of one entry per person during the Giveaway Entry Period for this method. 
  6. Visit Circle K on Facebook. You will automatically receive one (1) entry if you visit Circle K on Facebook through the Big Circle K Giveaway website. Limit of one entry per person during the Giveaway Entry Period for this method.
  7. Visit Circle K on TikTok. You will automatically receive one (1) entry if you visit Circle K on TikTok through the Big Circle K Giveaway website. Limit of one entry per person during the Giveaway Entry Period for this method.
  8. Answer survey question. You will automatically receive one (1) entry if you submit your answer to a survey question. Limit of one entry per person per day during the Giveaway Entry Period for this method.
  9. Free: Online Entry.  You will automatically receive one (1) entry if you go to http://games.circlek.com/us/big-giveaway?app=true  and provide the required information handwritten on lined paper that includes your name, email address and phone number and uploading a picture that includes the name “Circle K” and the date of the upload (i.e., “March 15, 2025”). Limit of two (2) actions per person per day during the Giveaway Entry Period for this method and must be done in lieu of Circle K Store Receipt Upload or Product UPC scan.

 

Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different phone numbers, or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any robotic, automatic, programmed, or similar entry method or the use of any means to obtain more than the stated number of Giveaway entries will void all entries and result in disqualification.

 

5. Winner Determination

  • Grand Prize Drawings: There will be five (5) random drawings for grand prizes. The random drawings will take place on or about the following dates: March 17, 2025, March 31, 2025, April 14, 2025, April 28, 2025 and May 12, 2025. At each drawing Sponsor will randomly select one (1) entry for a grand prize described below in a random drawing of all valid entries received up to the time of the drawing. Limit of one grand prize per household for the Giveaway. 
  • Weekly Prize Drawings: There will be eight (8) random drawings for weekly prizes. The random drawings will take place on or about the following dates: March 17, 2025, March 24, 2025, March 31, 2025, April 6, 2025, April 14, 2025, April 21, 2025, April 28, 2025 and May 4, 2025. At each drawing Sponsor will randomly select twenty-five (25) entries for a weekly prize described below in a random drawing of all valid entries received up to the time of the drawing. Limit of one weekly prize per household for the Giveaway.

 

Each potential winner will be contacted using the phone number and/or email address provided with entry and may be awarded the prize subject to verification of eligibility and compliance with the terms of these Official Rules. Each potential winner will be contacted by Sync Marketing LLC. Failure by a potential winner to respond to the initial verification within seven (7) business days of notification will result in disqualification and Sponsor may select an alternate potential winner in the same manner.

 

6. Odds

Odds of winning depend on the number of eligible entries received up to the time of the drawing. 

 

7. POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR. SPONSOR’S DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE ADMINISTRATION, OPERATION, SELECTION OF THE WINNERS AND OTHER MATTERS RELATED TO THE GIVEAWAY. 

 

8. Verification of Potential Winners

Potential winners may be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release (where permitted by law) (collectively, the “Affidavit”) by five (5) business days of notification being sent or the date specified by Sponsor or potential winner will be disqualified from the Giveaway. In the event: (a) potential winner cannot be reached for whatever reason after a reasonable effort has been exerted or the potential winner notification or Affidavit is returned as undeliverable; (b) potential winner declines or cannot accept, receive or use the prize for any reason; (c) of noncompliance with the above or within any of the aforesaid time periods, (d) potential winner is found to be ineligible to enter the Giveaway or receive the prize, (e) potential winner cannot or does not comply with the Official Rules, or (f) potential winner fails to fulfill the Affidavit-related obligations, the potential winner shall be disqualified from the Giveaway. Sponsor reserves the right to modify the notification and Affidavit procedures.

 

9. Prizes 

  • Grand Prizes: Five (5) grand prizes will be awarded. Each grand prize winner will receive one hundred thousand dollars ($100,000). 
  • Weekly Prizes: Two Hundred (200) weekly prizes will be awarded. Each weekly prize winner will receive a five hundred dollar ($500) Circle K Gift Card. Circle K Gift Card will be a physical card mailed to the address within the United States on file or provided by the winner. Circle K Gift Cards can be used for purchases at participating Circle K stores and Holiday Stationstores. Circle K Gift Cards are not debit or credit cards and are not redeemable for cash except to the extent required by law. Lost or stolen cards cannot be replaced. AFTER 60 MONTHS OF NO ACTIVITY, THIS CARD WILL BE SUSPENDED BUT THE CARD BALANCE NEVER EXPIRES. TO REPLACE A SUSPENDED CARD WITH YOUR REMAINING BALANCE, CALL 1-855-993-2383. The value of each prize will be taxable to the respective winner as income. All federal, state and local taxes and any other costs and expenses associated with the acceptance and/or use of prize not specifically provided for in these Official Rules are solely the Winner’s responsibility. Winners are solely responsible for reporting and paying any and all applicable taxes. Any residents of the 50 United States that win $600 or more in prizes will have income reported to them on IRS Form 1099, as required under IRS rules and a copy of said form will be sent to the IRS. Any Prize awarded above the threshold shall require the winner to provide the Sponsor with valid identification and a signed Form W-9 with a valid taxpayer identification number or social security number before any grand prize will be awarded. Each grand prize winner will receive an IRS Form 1099-MISC reflecting the total fair market value of his/her grand prize. Entrant must contact his/her own tax advisor for any questions concerning taxes. Approximate retail value of all prizes is $600,000.

 

10. Entry Conditions and Release

Each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor which are binding and final in all matters relating to this Giveaway; (b) defend, indemnify, release and hold harmless the Sponsor, Sync Marketing LLC and their respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Giveaway, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Giveaway, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winner acknowledges that the prize is awarded as-is without warranty of any kind.

 

11. Publicity

Except where prohibited or restricted by law, winner’s acceptance of prize constitutes the winner’s agreement and consent for Sponsor and any of its designees to use and/or publish winner’s full name, city and state/province/territory/country of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Giveaway or Sponsor, worldwide and in perpetuity for advertising, publicity, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.

 

12. General Conditions 

Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Giveaway or claiming the prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the prize for any reason; (f) if a prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any prize or resulting from participating in this Giveaway or any promotion or prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Giveaway, or with any Website promoting the Giveaway; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Giveaway multiple times through the use of multiple email addresses. If Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Giveaway, Sponsor reserves the right to void the entries at issue, and/or terminate the relevant portion of the Giveaway, including the entire Giveaway, and/or modify the Giveaway and/or award the prize from all eligible entries received as of the termination date.

 

13. Limitations of Liability

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Giveaway; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Giveaway; (d) technical or human error in the administration of the Giveaway or the processing of entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Giveaway or receipt or use or misuse of any prize; or (f) for lost, late, illegible, misdirected, inaccurate, incomplete, undelivered, damaged, delayed, entries. If for any reason an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Giveaway. No more than the stated number of each prize will be awarded.

 

14. Disputes

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Giveaway, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Giveaway, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate North Carolina State Court located in Mecklenburg, North Carolina; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Giveaway, but in no event attorneys’ fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
