Official Rules

NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  

Please read these rules before entering the Talk 2 Us Sweepstakes (the “Sweepstakes”). By entering and participating in the Sweepstakes, you agree to be bound by these official rules (the “Official Rules”) and represent that you satisfy all of the eligibility requirements set forth below.

1. THE SWEEPSTAKES

These Official Rules apply to the Sweepstakes (sponsored by Circle K Stores Inc. (the “Sponsor”), located at 1130 W Warner Rd., Building B, Tempe, AZ 85284, and administered by Qualtrics LLC, located at 333 W River Park Dr., Provo, UT 84604, and SIX12 Creative Inc., located at 210 - 4259 Canada Way, Burnaby, BC, V5G 1H1, Canada (each an “Administrator” and, collectively the “Administrators”). The Sweepstakes shall be available as of November 18, 2024, at 12:01 am EST and ends on April 26, 2026, at 11:59 pm EST (“Sweepstakes Entry Period”).  

2. Eligibility  

The Sweepstakes is open only to legal residents of the United States of America who are at least eighteen (18) years old at the time of entry. Proof of residency and age may be required. The following persons are not eligible to win a Prize (as such term is defined below): officers, directors, shareholders, employees, agents and/or representatives of the Sponsor and/or the Administrators and their respective affiliates or related companies, advertising agencies, licensees, franchisees, partners, retailers, distributors and/or any other party related to the Sweepstakes. Also, any member of the immediate family of the persons mentioned in this section and any person living with them under the same roof (whether or not a member of their immediate family) are not eligible to win a Prize. The term “immediate family” means fathers, mothers, brothers, sisters, children, husbands, wives or spouses of the persons mention in this section, regardless of where they live. The Sweepstakes is not open and void where prohibited by law.

3. How to Enter 

To become an eligible entrant (“Entrant”) and be entered into the Sweepstakes, you must first visit the Sweepstakes Website located at https://bit.ly/3YAbEF8 (“Survey Website”), fill out the store survey, and submit the online Sweepstakes opt-in form in its entirety. After completing the survey, you must enter your first and last name, mobile number and email address and agree to these Official Rules as well as the Sponsor’s privacy policy to be eligible for a Prize. The opt-in process will grant the Entrant one (1) entry into the Sweepstakes. LIMIT: Entrants will receive a maximum of one (1) entry per eligible Circle K store surveyed, per week, during the Sweepstakes Entry Period (each an “Entry” and collectively, the “Entries”). Surveys received in duplicate for the same store on the same day will not result in additional entries. 

ONLINE ALTERNATIVE METHOD OF ENTRY

Visit this link (https://forms.gle/hgtop6UPNoGWY25m6) and follow the instructions to complete and submit the registration form, including a valid email address, full name, home address, phone number, and age. The receipt of each entry will be based on the delivery date of the completed form and must be received within the Sweepstakes Entry Period to be considered eligible to win. All entries become the exclusive property of the Sponsor, and none will be acknowledged or returned. Upon receipt of the submission (each a “Submission”), the Entrant will receive one entry into the Sweepstakes. LIMIT: Entrants will receive a maximum of one (1) entry per eligible Submission, per week, during the Sweepstakes Entry Period. Any entries that are incomplete, illegible, corrupted, damaged, destroyed, false, lost, late, misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified, at the Sponsor’s sole and absolute discretion.

4. Prizes 

Two hundred forty-seven (247) Circle K gift cards in the amount of one hundred ($100) dollars each (each a “Prize” and collectively the “Prizes”) are available to be won during the Sweepstakes Entry Period. The approximate retail value (“ARV”) of all Prizes is $24,700 US; not to exceed $5,700 in Florida.  

Prizes must be accepted as awarded and cannot be transferred, substituted, or redeemed for cash or credit. The Sponsor, in its sole discretion, reserves the right to: (i) substitute all or any portion of the Prizes with another prize or portion thereof of equal or greater value; (ii) limit the number of Prizes awarded to the same person, mobile phone number, or physical address; and (iii) modify the Prizes, associated quantities and award schedule at any time during the Sweepstakes. Under no circumstances will the Sponsor be responsible for awarding any items in excess of the Prizes and their respective quantities as listed above. Gift card redeemable only at participating Circle K or Holiday Stationstores.

5. Winner Selection & Prize Fulfillment 

Thirteen (13) potential winners will be selected per Business Unit (as defined below) by a random drawing during the contest period as follows to win one (1) Circle K gift card in the amount of one hundred dollars($100):

Please refer to the Circle K Website (https://www.circlek.com/) in order to determine in which Business Unit your store is located. Once you are on the site, select the tab labeled “Select your Region”, select “US”,  and hover over the map to find your Business Unit. This website may be updated from time to time.

Drawings will be conducted by SIX12 Creative Inc., located at 210 - 4259 Canada Way, Burnaby, BC, V5G 1H1, Canada, at 12:00pm EST on the dates set forth above. Odds of winning will depend on the number of eligible Entries received for each specific Business Unit at the time of the Prize draw. Note that non-selected Entries from each drawing will not carry forward to the next draw. LIMIT: One (1) Prize per individual, per household, per 12-month period. 

To claim a Prize, the potential winner must follow the instructions contained in their notification. Potential winners will be notified via e-mail, text message, and/or phone call. Potential winners will be notified up to three (3) times. The first notification will occur immediately after the random drawing. Second notification attempt will occur two (2) business days thereafter, and third notification attempt will occur after four (4) business days.  Potential winners failing to respond after three (3) notifications over five (5) business days will forfeit their Prize. In the event of a potential winner forfeit, no additional potential winner will be selected for that Prize and the Prize will not be awarded. 

All Prizes must be claimed within five (5) business days of notification by the Sponsor. Before being declared a winner, potential winners may also be required to sign a declaration and release form confirming compliance with the Official Rules and acceptance of the Prize as awarded, and releasing Sponsor and its affiliates, employees, directors, officers, suppliers, agents, and Administrators from any and all liability for any loss, harm, damages, cost, or expense arising out of participation in this Sweepstakes or participation in any prize-related activity, or the acceptance, use, or misuse of any Prize, including, without limitation, costs, injuries, losses, and damages related to personal injuries, death, damage to, loss, or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, or from any and all claims of third parties arising therefrom. The potential winner will be asked to provide a photograph of valid government issued identification in order to verify age and residency requirements. 

Such declaration and release form must be returned to the Sponsor within five (5) business days of the notification date indicated on the form or the potential winner will be disqualified and the Prize forfeited. If a potential winner declines the Prize, cannot be contacted by the Sponsor, does not claim their Prize, does not fully complete the declaration and release form, or otherwise fails to comply with the Official Rules, said Entrant will be disqualified and their Prize will be declared void. Sponsor is not responsible for the failure for any reason whatsoever of potential winners to receive any notification or to respond as prescribed above. Unclaimed or voided prizes will not be awarded to another Entrant.   

NOTE: Gift cards ship with a $0 balance for security reasons. Once received, the winner will be asked to notify the Administrator that the card has arrived. At that time the gift card will be activated and the $100 balance will be available for use within 3-5 business days. 

6. Entry Conditions and Release 

Each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor and Administrators which are binding and final in all matters relating to this Sweepstakes; (b) defend, indemnify, release and hold harmless the Sponsor, Administrators, and their respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an Entrant’s Entry, creation of an Entry or submission of an Entry, participation in the Sweepstakes, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of Prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winners acknowledge that the Prize is awarded as-is without warranty of any kind. 

7. Publicity 

Except where prohibited or restricted by law, the winner’s acceptance of the Prize constitutes the winner’s agreement and consent for the Sponsor and any of its designees to use and/or publish the winner’s full name, city and state of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Sweepstakes or Sponsor, worldwide and in perpetuity for advertising, publicity, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval. 

8. General Conditions 

Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any Prize to Entrants, with regard to: (a) Entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) Entries, Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) Entrants who have committed fraud or deception in entering or participating in the Sweepstakes or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the Prize for any reason; (f) if a Prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any Prize or resulting from participating in this Sweepstakes or any promotion or Prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Sweepstakes or with any Website promoting the Sweepstakes; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Sweepstakes multiple times through the use of multiple email addresses. Suppose Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Sweepstakes. In that case, Sponsor reserves the right to void the Entries at issue and/or terminate the relevant portion of the Sweepstakes, including the entire Sweepstakes, and/or modify the Sweepstakes and/or award the Prize from all eligible Entries received as of the termination date. 

9. Limitations of Liability 

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by Entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error in the administration of the Sweepstakes or the processing of entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize; or (f) for lost, late, illegible, misdirected, inaccurate, incomplete, undelivered, damaged, delayed, entries. If for any reason, an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of each Prize will be awarded. 

10. Disputes 

Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any Prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate North Carolina State Court; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (d) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina. 

11. Entrant’s Personal Information 

Information collected from entrants is subject to the Sponsor’s Privacy Policy, available at https://www.circlek.com/privacy-policy.
